JOYCAST – TERMS OF SERVICE

Please read these Terms of Service (“Terms”) carefully before using the Joycast website and services.

By accessing our website, subscribing to our services, or engaging us for podcast production, you agree to be bound by these Terms. If you do not agree, do not use our services.




1. About Us

2. Our Services



We provide professional podcast production services including, but not limited to:


  • Video and audio podcast editing

  • Short-form content creation for social media

  • Thumbnail design

  • SEO-optimised titles and descriptions

  • Scheduling and publishing assistance



We may update, improve, or change services at any time without notice, provided existing client obligations are met.




3. Client Responsibilities



You agree to:


  • Supply all raw content in agreed formats, free of malware and corruption.

  • Ensure you have full rights and permissions for all materials you provide, including music, images, and guest appearances.

  • Provide timely feedback, approvals, and requested assets to allow us to meet agreed deadlines.

  • Not submit any unlawful, defamatory, or infringing content.



You remain solely responsible for the content of your podcast and any legal compliance, including advertising standards, copyright laws, and data protection regulations.




4. Payment Terms



  • Services are billed in advance on a subscription or agreed project basis.

  • Work will not commence until payment is received in full.

  • Payments are non-refundable except where required by law.

  • Late payments may incur interest at 8% above the Bank of England base rate and/or suspension of services until payment is made.





5. Turnaround & Revisions



  • Standard turnaround times will be agreed at the start of the engagement.

  • Unless otherwise stated, one round of reasonable revisions per deliverable is included. Additional revisions will be billed at our standard hourly rate.

  • Revisions must be requested within 7 calendar days of delivery; after that, the work will be deemed accepted.





6. Intellectual Property



  • All intellectual property in the final edited podcast is transferred to you only upon full payment of all fees due.

  • We reserve the right to use completed works, excerpts, or screenshots for our portfolio, marketing, or case studies unless you request otherwise in writing before work begins.

  • All pre-existing intellectual property (logos, icons, music, templates) remains the property of its original owner.





7. Cancellations & Refunds



  • Monthly subscriptions renew automatically unless cancelled in writing at least 7 days before the next billing date.

  • No refunds will be issued for unused services or partial months once work has begun.

  • We reserve the right to cancel a subscription or project at any time if you breach these Terms. In such cases, no refunds will be provided.





8. Confidentiality



We will treat all unreleased client content as confidential and will not share it with third parties without your consent, except as required by law.




9. Liability & Indemnity



  • We are not liable for:


    • Any indirect, incidental, or consequential loss (including loss of profits, business, or reputation).

    • Delays caused by your failure to provide materials or feedback on time.

    • Copyright strikes, takedowns, or legal claims arising from your content.


  • Our total liability to you shall not exceed the total amount paid to us in the 3 months preceding the claim.

  • You agree to indemnify us against any claims, damages, or legal costs arising from your breach of these Terms.





10. Service Availability



We make reasonable efforts to ensure continuous service but do not guarantee uninterrupted or error-free performance. Maintenance, upgrades, or technical issues may result in temporary service suspension without notice.




11. Dispute Resolution



If a dispute arises, you agree to attempt to resolve it with us in good faith before taking legal action. Any disputes will be governed by the laws of England and Wales, and the courts of England and Wales will have exclusive jurisdiction.




12. Changes to These Terms



We may update these Terms from time to time. Updated versions will be posted on our website and will take effect immediately upon posting.
